YAKIMA -- A jury has convicted an ex-Wapato teacher on two charges of second-degree child rape. Jesus Barcenas faces life in prison, even though the jury dismissed two counts of first-degree child rape, and an additional second-degree charge. The victim's mother looked upset about the outcome, but deputy prosecutor Patti Powers tells us she's pleased with the jury's decision.
"It was a good result. We were hopeful for [the first-degree convictions], but I respect the fact that this jury rolled up it's sleeves and gave it their best effort," says Powers.
Barcenas was accused of molesting his 12-year-old student at Adams Elementary school in 2007. He began dating the girl's mother, and eventually moved into her home. The victim testified that she had sex with Barcenas many times, and that he would write her notes about when to meet up. Barcenas' attorney argued the girl was infatuated with her teacher and made up the allegations. The girl was not present in court for the verdict.
Sentencing in the case is scheduled for December 18th. Powers say the judge will decide the minimum Barcenas must serve on his life sentence before being up for parole.
