An emergency stay is lifted on the sentencing of a Yakima man, formerly accused of killing three people in West Valley.

The Court of Appeals denied the state's effort to re-file charges against Kevin Harper for the deaths of Bill, Pauline and Bettye Goggin back in 2011.

Prosecutors took the case to the appeals court, hoping to get the Superior Court's ruling thrown out.

Harper, who was formerly charged with three counts of murder, will now be sentenced on lesser charges as part of a plea agreement.
