The Benton County prosecutor says it is unlikely he will seek the death penalty in Kennewick's most recent murder case.

Grant Wayne Scantling is accused of killing 24 year-old Franklin Palmer at a duplex on East 8th Place last month.

Prosecutor Andy Miller says he is still waiting on police reports to review, and he has not decided if he will seek the death penalty.

However, he says it appears this case will not meet the criteria for a death penalty case.

Scantling will be back in court for an update on this issue on April 24th.
